How to withdraw from a distance contract

  1. A consumer who buys goods online may withdraw from the distance sales contract within 14 days without giving a reason.
  2. The period in point 1 starts when the consumer, or a person designated by the consumer other than the carrier, takes delivery of the product.
  3. If the contract covers several products delivered separately, in batches or in parts, the period in point 1 starts on delivery of the last item, batch or part.
  4. To withdraw, the consumer must inform the seller of that decision. It is enough to send the notice before the withdrawal period expires.
  5. The consumer may send the notice by post, by fax or by email to the seller, or submit it on the seller’s website. The seller’s contact details are in section 3 of the shop terms. The consumer may use the model form in Annex 1 to the terms or the model form annexed to the Polish Consumer Rights Act of 30 May 2014. Use of the form is optional.
  6. If the consumer sends the notice electronically, the seller will promptly confirm receipt by email to the address provided by the consumer.

7. Effects of withdrawal

  1. If the consumer withdraws from a distance contract, the contract is treated as if it had never been concluded.
  2. The seller will refund all payments received from the consumer, including delivery costs, without undue delay and within 14 days of receiving the notice of withdrawal. If the consumer chose a delivery method other than the least expensive standard delivery offered by the seller, the additional cost is excluded from the refund.
  3. The seller will use the same means of payment as the consumer used for the original transaction, unless the consumer expressly agrees to another method that entails no cost to them.
  4. The seller may withhold the refund until the product is returned or the consumer provides evidence of sending it back, whichever happens first.
  5. The consumer must send the product back to the seller’s address given in the shop terms without undue delay and within 14 days of informing the seller of the withdrawal. Sending the product before the end of that period meets the deadline.
  6. The consumer bears the direct cost of returning the product, including when its nature prevents it from being returned by ordinary post.
  7. The consumer is liable only for a reduction in the product’s value resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
  8. If the nature of a product prevents it from being returned by ordinary post, its description in the shop will state this and specify the cost of return.

16. Contracts excluded from the consumer’s right to withdraw

  1. Contracts for goods that are not prefabricated and are made to the consumer’s specifications or to meet their individual needs.
  2. Contracts for goods delivered in sealed packaging that cannot be returned for health protection or hygiene reasons once opened, if the packaging has been opened after delivery.
  3. Contracts for goods that deteriorate rapidly or have a short shelf life.
  4. Service contracts if the seller has fully performed the service with the express consent of the consumer, who was informed before performance began that they would lose the right to withdraw once the service had been fully performed.
  5. Contracts where the price or remuneration depends on fluctuations in the financial market that are beyond the seller’s control and may occur before the withdrawal period expires.
  6. Contracts for goods that, by their nature, become inseparably mixed with other goods after delivery.
  7. Contracts for alcoholic beverages whose price was agreed when the sale was concluded, which can be delivered only after 30 days and whose value depends on market fluctuations beyond the seller’s control.
  8. Contracts for sound or video recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery.
  9. Contracts for the supply of newspapers, periodicals or magazines, except for subscription contracts.
  10. Contracts for the supply of digital content without a tangible medium if performance began with the consumer’s express consent before the withdrawal period expired and after the seller informed the consumer that they would lose the right to withdraw.
